ENGLEWOOD, N.J. — August 27, 2026 — Allied Neurology & Interventional Pain Practice (ANIPP) welcomed attorneys and staff to a dinner seminar Thursday evening on one of the most consequential and least understood provisions in New Jersey no-fault law: the statutory expansion of PIP medical expense benefits to $250,000 for injuries of the central nervous system.
Sandy Moscaritolo, Esq., a widely respected attorney, judge, and authority on New Jersey PIP practice, delivered the featured presentation. Mr. Moscaritolo walked the room through the mechanics of N.J.S.A. 39:6A-4.3(e) with the clarity and practical command that have made him a sought-after speaker on these issues for years. He reviewed the distinction between spinal cord injury and general spinal pathology — a distinction that quietly decides a great many claims — and the objective findings required in traumatic brain injury. He also discussed the documents necessary to apply for the conversion to $250,000 catastrophic coverage, and provided them to the audience.
The evening’s message was encouraging. Where an insured elected a reduced medical expense limit, or carries a Basic Policy, the statute restores the full $250,000 for all medically necessary treatment of permanent or significant brain injury, spinal cord injury, or disfigurement. The expansion is self-executing; it operates by force of law upon the existence of the qualifying injury. In the substantial majority of cases where genuine CNS injury is present and properly documented, the $250,000 limit is achievable.
The obstacle is rarely the law. It is documentation. That is the gap ANIPP has spent years closing, with a system built directly on the statutory elements: anatomic diagnosis stated in operative terms, objective substrate itemized with dates and values, permanency stated in the language New Jersey arbitrators recognize, and medical necessity addressed against each subclause of N.J.A.C. 11:3-4.2. Attendees received the practice’s clause library and pre-transmission checklist.
